1. Acceptance of These Terms
These Website Terms of Use ("Terms") govern access to and use of pinkysautomotive.com (the "Website"), operated by Pinky's Automotive ("Pinky's," "we," "us," or "our"). By using the Website, you agree to these Terms. If you do not agree, do not use the Website.
2. Website Information Only
Website content is provided for general information and service-request purposes. It is not a vehicle diagnosis, safety inspection, repair recommendation, professional opinion, estimate, quote, warranty, or guarantee. Vehicle conditions vary, and reliable recommendations may require an in-person inspection and diagnostic testing.
If a vehicle may be unsafe to drive, do not rely on the Website. Stop driving when it is safe and contact an appropriate towing, roadside-assistance, emergency, or repair service.
3. Service Requests and Appointments
Submitting a service request does not:
- Confirm an appointment or service time.
- Guarantee same-day service, parts availability, completion time, price, or outcome.
- Create an estimate, work order, repair contract, or warranty.
- Authorize Pinky's to inspect, diagnose, test-drive, store, repair, or otherwise work on a vehicle.
An appointment exists only after Pinky's confirms it. Any inspection, diagnosis, estimate, authorization, repair, payment, storage, warranty, or other shop service is governed by the documents provided for that transaction, including any written estimate, work order, authorization, invoice, or warranty. If a transaction-specific document conflicts with these Terms regarding shop services, that document controls.
4. Accurate Submissions and Acceptable Use
You agree to provide accurate, current information and submit requests only for yourself or with the vehicle owner's authorization. You may not:
- Use the Website for unlawful, fraudulent, abusive, or deceptive activity.
- Submit malicious code, spam, false requests, or content that infringes another person's rights.
- Interfere with the Website, bypass security measures, burden our systems, or attempt unauthorized access.
- Impersonate another person or misrepresent your affiliation or authority.
We may reject or remove submissions and restrict access when reasonably necessary to protect the Website, Pinky's, our customers, or others.
5. Communications
When you provide contact information and submit a request, you authorize Pinky's to contact you about that request using the method you selected, including telephone, email, or text message. Selecting "Text Message" authorizes nonmarketing texts related to your request. Consent to marketing communications is not a condition of purchasing goods or services.
Message and data rates may apply. Message frequency varies. You may opt out of nonessential text messages by replying STOP. Opting out does not prevent communications needed to complete or respond to a transaction you initiated, to the extent permitted by law.
6. Intellectual Property
The Website and its content—including text, graphics, photographs, logos, design, layout, and software—are owned by Pinky's or its licensors and protected by intellectual-property laws. Pinky's grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Website for personal, noncommercial purposes.
You may not reproduce, distribute, modify, publicly display, sell, license, or create derivative works from Website content without prior written permission, except as allowed by law.
7. Feedback and Submitted Content
You retain ownership of content you submit. You grant Pinky's a nonexclusive, worldwide, royalty-free license to use, reproduce, transmit, and store it only as reasonably necessary to respond to your request, operate the Website and business, maintain records, comply with law, and protect our rights. Personal information is handled as described in our Privacy Policy.
8. Third-Party Links and Services
The Website may link to third-party services such as maps, social media, and review platforms. Pinky's does not control and is not responsible for their content, availability, security, terms, or privacy practices. A link does not imply endorsement.
9. Website Availability and Changes
We may change, suspend, or discontinue any part of the Website. We do not guarantee it will always be available, error-free, secure, or current. We may correct errors and update service descriptions, hours, locations, or other information without notice.
10. Disclaimers
To the fullest extent permitted by law, the Website and its content are provided "as is" and "as available." Pinky's disclaims all express and implied warranties relating to the Website, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy.
Nothing in these Terms excludes a warranty, duty, or remedy that cannot lawfully be excluded. Any written warranty for repair services is governed by its own terms.
11. Limitation of Liability
To the fullest extent permitted by law, Pinky's and its owners, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of use, or business interruption arising from the Website.
To the fullest extent permitted by law, Pinky's total liability for claims arising solely from the Website will not exceed the greater of the amount you paid, if any, specifically to use the Website during the six months before the event giving rise to the claim or $100. These limits do not restrict obligations or remedies under a separate vehicle-repair transaction where doing so would be unlawful or inconsistent with that transaction's documents.
12. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless Pinky's and its owners, employees, and agents from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful misuse of the Website, violation of these Terms, or content you submit that infringes another person's rights. This does not require indemnification for Pinky's own unlawful conduct.
13. Governing Law and Venue
These Terms are governed by California law, without regard to conflict-of-law rules. Subject to any nonwaivable right, disputes relating solely to the Website will be brought in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
14. Changes to These Terms
We may update these Terms by posting a revised version and changing the "last updated" date. Changes apply prospectively unless additional notice or consent is required by law. Continued use after the effective date constitutes acceptance of the revised Terms.
15. Severability; No Waiver; Entire Agreement
If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions remain effective. Failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement concerning Website use, but they do not replace transaction-specific repair documents.
